We are seeking

Bitdeer (NASDAQ: BTDR) is looking for a litigator with federal regulatory experience to join our U.S. Legal team as Senior Legal Counsel, Litigation & Regulatory Affairs. Bitdeer builds and operates data center and power infrastructure across multiple U.S. states, and the legal risk that comes with it runs in two directions. There are disputes — commercial, construction and energy contract claims, insurance coverage and subrogation, employment, bankruptcy, and land use matters. And there is a widening federal regulatory surface spanning export controls and trade compliance, equipment authorization and supply-chain security, bulk-power-system requirements, foreign investment review, and public-company obligations.

You will carry a litigation docket alongside our existing litigation counsel along with the federal regulatory and government interface as a named second mandate: tracking the agency proceedings and policy developments that affect our sites and our supply chain, preparing and coordinating Bitdeer's responses to federal inquiries, and working with outside counsel and our government relations advisors to put the company's position in front of the agencies and policymakers that matter to it. The role reports to the General Counsel, North America. We are open to candidates based in Washington, DC or Northern Virginia and in Ohio, with San Jose, California and Austin, Texas also considered.

What you will be responsible for

Litigation and disputes

  • Manage a portfolio of disputes from first notice through resolution — commercial, construction and energy contract claims, insurance coverage and subrogation, employment, bankruptcy and creditor matters, and land use and zoning disputes — in state and federal court and in arbitration.

  • Develop case strategy, exposure analysis and resolution options, and give clear, commercially grounded recommendations to senior management.

  • Direct outside counsel on strategy, staffing, work quality, deadlines and budgets.

  • Stay hands-on in the work: draft and review pleadings, dispositive motions and briefs, prepare witnesses, and take part in depositions, hearings, mediations and arbitrations.

  • Run discovery, including litigation holds, document preservation, eDiscovery collections, privilege review and productions.

  • Handle pre-suit disputes, demand letters and insurance claims, and negotiate settlements on commercially practical terms.

Federal regulatory and government interface

  • Serve as the U.S. Legal team's point of contact for federal regulatory matters, coordinating across export controls and trade compliance, equipment authorization and supply-chain security, bulk-power-system and energy requirements, foreign investment review, and public-company obligations.

  • Prepare and coordinate Bitdeer's responses to federal agency inquiries, information requests, subpoenas and civil investigative demands, and manage parallel or overlapping proceedings involving more than one agency at a time.

  • Conduct or oversee internal investigations arising from regulatory exposure, and advise on voluntary disclosure where it is the right call.

  • Track federal legislative, rulemaking and enforcement developments relevant to data center load growth, energy infrastructure, digital assets and technology supply chains, and translate them into practical guidance the business can act on.

  • Work with outside counsel and Bitdeer's government relations advisors to develop and present the company's positions to federal agencies and policymakers, and support comment filings and industry coalition participation.

  • Advise on the rules governing that engagement — lobbying registration and reporting, gift and ethics restrictions, and political activity — and keep the company's advocacy inside them.

Across both

Partner with project, construction, energy, procurement, HR and finance teams to identify legal and regulatory risk early and improve contract terms and operating practices.
Provide litigation and regulatory status, exposure and loss-contingency input to Finance, auditors and the public-company disclosure process.
Support management on other legal matters as assigned.

How you will stand out

  • J.D. from an ABA-accredited law school and active bar membership in good standing, with the ability to meet in-house counsel registration requirements in the jurisdiction where you will be based.

  • 7+ years of litigation experience at a leading law firm, in government service, and/or as in-house counsel.

  • A record of managing disputes end to end — substantive motion practice, discovery and expert work, and trial, arbitration or hearing experience.

  • Experience with federal regulatory proceedings, enforcement matters or investigations — including responding to agency information requests, subpoenas or civil investigative demands, and handling matters that involve more than one agency at the same time.

  • A practical understanding of how federal agencies and Congress work: who decides what, how a company's position actually gets heard, and what it can and cannot do to advance one.

  • Experience managing outside counsel and budgets, and the judgment to make clear recommendations under time pressure.

  • Excellent writing and oral advocacy skills.

  • High self-motivation and a collaborative style suited to a fast-growing, global company.

  • Ability to work with colleagues across Asia and North America, including some meetings outside U.S. business hours, and to travel to project sites, agency meetings, courts and hearings as needed.

  • Prior service with a federal enforcement, regulatory or prosecutorial agency, or substantial practice before one.

  • Experience in one or more of: export controls and sanctions, equipment authorization and supply-chain security, foreign investment review, energy and bulk-power regulation, or digital asset regulation.

  • In-house experience at a public company, or disputes experience in energy, power, construction, real estate or infrastructure.

  • Experience supporting or coordinating government relations, trade association or coalition activity, or regulatory comment filings.

  • Securities litigation, insurance coverage, employment litigation, or land use and zoning experience.

What you will experience working with us

A culture that values authenticity and diverse perspectives.
An inclusive, respectful environment with open workspaces and an energetic, start-up spirit.
A fast-growing company with opportunities to network with industry pioneers and enthusiasts.
The ability to contribute directly and make an impact on the future of the digital asset and AI computing industry.
Involvement in new projects and in developing processes/systems.
Personal accountability, autonomy, rapid growth, and learning opportunities.
Attractive benefits and development such as training and mentoring.
